I am a practicing litigator as well, although I don&#039;t practice criminal law.  My understanding of Polanski&#039;s case is that there is no witness who could testify of Polanski admitting anything.  Polanski can&#039;t be forced to testify against himself and the victim has declined to testify against him.  Given that, it appeared to me that they would have a tough time convicting him if the guilty plea was not valid and they had to retry him.</description>
